Mandatory Maryland Liability Coverages

 

Bodily Injury
Bodily injury coverage is mandatory in Maryland. If the Maryland policyholder or another driver covered by the Maryland auto insurance policy is found to be at fault in an accident resulting in injuries or fatalities, the following is covered under bodily injury coverage:

  • Medical expenses
  • Lost wages
  • Pain and suffering
  • Legal defense if the drivers listed on the policy are involved in a lawsuit resulting from a car accident

Bodily injury coverage pays for damages caused to a third party.

Property Damage
If you or another covered driver is found to be at fault in an accident, the following is covered under property damage coverage:

  • Damage to another person's property (e.g., fence, car, or home)
  • Legal costs associated with a damage incident

Personal Injury Protection (PIP)
PIP is mandatory in Maryland. There are 2 PIP plans you can choose from: full coverage and limited coverage.

Full Coverage PIP
  • Medical expenses– These may include medical and surgical treatment; dental and optometric treatment; ambulance and nursing services; necessary medications, medical supplies, and prosthetic devices.
  • Lost wages– If you or your passengers are unable to work due to accident-related injuries, PIP helps you recover your lost wages.
  • Substitute services– Should you or your regular passengers need help performing household or other tasks due to accident-related injuries, PIP also helps pay for such substitute services.
  • Funeral expenses– If a covered individual dies from accident-related injuries, PIP helps pay for related funeral expenses.
The full coverage plan provides protection to the policyholder, policyholder’s spouse, and members of the policyholder’s household. It also applies to policyholders and household members, who are under the age of 16 or who are over 16 and have not waived their PIP, if they’re injured while riding in someone else’s car or as a pedestrian when struck by another vehicle.

Limited Coverage PIP

  • Lost wages– If you or your passengers are unable to work due to accident-related injuries, PIP helps you recover your lost wages.

Uninsured Motorist Property Damage
Uninsured motorist property damage coverage is mandatory in the state of Maryland. Your limits for this coverage can't exceed your property damage limits.

This auto insurance coverage provides protection to a policyholder whose vehicle is damaged in an accident involving a driver who has no insurance coverage.

You'll have to pay a $250 deductible for this coverage if you file an auto insurance claim.

Optional Maryland Auto Insurance Coverage

 

Uninsured/Underinsured Motorist Bodily Injury
If you choose to have uninsured/underinsured motorist bodily injury on your Maryland policy and you want it to apply to multiple cars, you must select the same limit for each car. Also, the limits you choose must be less than, or equal to, your bodily injury limits.

If the covered individuals are injured in an accident caused by a driver who has no auto insurance or insufficient coverage, compensatory damages that a policyholder is entitled to receive, will be covered.

If you’re injured in an accident caused by a driver who has no auto insurance coverage, uninsured motorist bodily injury coverage covers the following expenses:

  • Medical
  • Lost wages
  • Other general damages
  • Injuries sustained in hit-and-run accidents

Uninsured/underinsured motorist bodily injury provides coverage to the policyholder, authorized policy members, and passengers.

If the other driver is uninsured, this coverage can generally pay up to the limit you purchase. If the driver is underinsured, this coverage typically pays the difference between what’s covered by the other driver's insurance and what’s covered by your bodily injury coverage.

If the limits you purchase are lower than an accident's costs, you’ll be responsible for paying the amount over your limits, unless you’re covered by health insurance.
